Here's the 2026 twist: every assured tenancy in England is now a rolling tenancy. The Renters' Rights Act abolished fixed terms on 1 May 2026, so the rolling arrangement that used to kick in only after a fixed term expired is now how every tenancy works from day one.
Old rolling tenancies vs the new framework
Before the reform, a rolling tenancy was usually a "statutory periodic" tenancy arising when an AST's fixed term ended, inheriting the old agreement's terms. Landlords could end it with a Section 21 notice. Now, the tenancy is periodic from the outset, Section 21 is gone, and tenants give two months' notice from a rent day. Agreements drafted for the old arrangement misstate all three points.
