Why old templates fail

Most free tenancy agreement templates are now legally out of date

On 1 May 2026 the Renters' Rights Act 2025 came into force in England. Assured shorthold tenancies were abolished, all tenancies became open-ended periodic tenancies, and Section 21 "no-fault" notices can no longer be served. A template that refers to a fixed term, an AST, or Section 21 describes a tenancy type that no longer exists, and using one creates avoidable disputes about what terms actually apply.

1.1 Abolished

No fixed terms

All new tenancies are monthly periodic. Clauses locking tenants in for 6 or 12 months are unenforceable.

1.2 Repealed

No Section 21

Possession now runs through the revised Section 8 grounds. Your agreement should reflect the new framework.

1.3 Mandatory
